Terms of Service
1. Scope of Application
These Terms of Service govern all contracts for the sale of goods that consumers or entrepreneurs (hereinafter “Customer”) enter into with the Seller through the online shop. A consumer is any natural person who enters into a legal transaction primarily for purposes that are outside their commercial or professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who acts in the exercise of their commercial or independent professional activity when concluding the contract.
2. Conclusion of Contract
2.1 The products offered in the online shop constitute a binding offer by the Seller to sell these goods.
2.2 Customers submit a binding contract offer using the online order form. The contract is concluded upon confirmation by the Seller, either via written confirmation, email, or delivery of the products.
2.3 The Seller may accept the Customer’s offer within five days of receipt. If the offer is not accepted within this period, the Customer is no longer bound by their offer.
3. Right of Withdrawal
Consumers have the statutory right to withdraw from the contract. Detailed information about the withdrawal process is provided in a separate Withdrawal Policy.
4. Prices and Payment Terms
4.1 Prices include applicable taxes and any other price components.
4.2 Payment can be made via the methods provided during the ordering process.
4.3 Payment service providers may process selected payment options. Applicable terms of the respective provider apply.
5. Delivery and Shipping
5.1 Deliveries are made to the Customer’s specified address unless otherwise agreed.
5.2 Shipping costs are calculated and displayed during the ordering process.
5.3 Delivery times depend on product availability and begin upon order confirmation.
6. Retention of Title
All goods remain the property of the Seller until full payment has been received.
7. Warranty and Liability
7.1 Statutory warranty rights apply.
7.2 The warranty period is generally two years from the date of delivery.
7.3 Liability for damages beyond statutory provisions is limited to intent or gross negligence.
8. Applicable Law
The law of the Seller’s country of establishment applies, excluding the UN Convention on Contracts for the International Sale of Goods.
9. Place of Jurisdiction
For disputes with entrepreneurs, legal entities under public law, or public special funds, the jurisdiction is the Seller’s registered office.
10. Alternative Dispute Resolution
The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr. The Seller is not obligated or willing to participate in dispute resolution before a consumer arbitration board.
